H1-B Scholar

The H-1B visa is a non-immigrant visa that allows US companies to employ foreign workers in specialty occupations that require theoretical or technical expertise in specialized fields such as in architecture, engineering, mathematics, science, and medicine.

Under the visa, a US company can employ a foreign worker for up to six years.The H1-B category has a minimum stay of two months, and a maximum continuous stay of 6 years. The six-year "clock" begins with the start date on the Form I-797. H-1B status remains available until the end of six years from that date or until the date the H-1B program is concluded, whichever is earlier.

At TDU, the initial Form I-797 will be issued for the duration of the academic appointment and can be extended up to a maximum of six years. However, when employment at TDU is completed, so is the H-1B status, unless the scholar transfers immediately to another H-1B sponsor.
